Respondent Prayer : Petition filed under Article 227 of Constitution of India, to direct the learned Rent Controller to dispose the E.P.No.9 of 2012 in R.C.O.P.No.1 of 2008 on the file of the learned Rent Controller (Principal District Munsif Court), Tirunelveli within a time limit fixed by this Court by allowing this Civil Revision Petition.

ORDER

This Revision is filed praying a direction to the learned Principal Rent Controller(Principal District Munsif), Tirunelveli, to dispose of E.P.No.9 of 2012 in R.C.O.P.No.1 of 2008, within a time frame.

2. Heard the learned counsel for the petitioner and perused the records.

3. Mr.T.Selvan, learned counsel for the petitioner would submit that the petitioner is a landlord and the respondent is a tenant. The petitioner initiated an Eviction petition against the respondent in the year 2008, on the ground of willful default. The learned Rent Controller ordered eviction on 08.11.2011, which was confirmed by the learned Rent Control Appellate Authority in R.C.A.No.17 of 2012 and by this Court in C.R.P.(NPD)(MD)No.1848 of 2014.

4. It is further submitted that based on the order, the petitioner has already filed an Execution Petition, however, the respondent/tenant who is liable to pay Rs.18,34,250/- towards https://hcservices.ecourts.gov.in/hcservices/

arrears of rent, has been deliberately dragging on the proceedings by filing applications in E.A.No.435 of 2015 and E.A.No.436 of 2015, when the Execution petition was posted for orders.

Considering the said submissions made by the learned counsel for the petitioner and without going into the merits of this case, the learned Principal Rent Controller(Principal District Munsif), Tirunelveli is directed to dispose of the interim applications and the E.P.No.9 of 2012 in R.C.O.P.No.1 of 2008 as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order.

6. With the above directions, the Civil Revision Petition is disposed of. No costs.
