ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned orders passed by the 1st Respondent vide Na.Ka.No.5067/Aa/2023 dated 09.01.2024 confirming the order dated 27.10.2023 passed by the 2nd respondent and consequently to direct the 2nd respondent to register the certified copy of the decree, dated 25.09.2018, passed in the suit in O.S.No.15 of 2005 on the file of the Sub Court of Kumbakonam and the decree dated 11.03.2020 confirmed by the learned Additional District Court, Fast Track Court Kumbakonam in A.S.No.1 of 2019, within a time frame.

2. Through the impugned refusal check slip, the respondents refused to register the document stating that the suit has been dismissed without holding who is entitled to the relief. The said reasoning is totally non2/4

application of mind. The petitioner is seeking to register the judgment and decree which was dismissed against the plaintiff. The petitioner herein was the defendant in the suit. The reasons stated that the suit was dismissed without granting any relief to anybody is erroneous and incorrect reason. Therefore, the same is quashed. The second respondent is directed to register the same within a period of four weeks from the date of receipt of a copy of this order.

3.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
