ORDER : The Court Made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offence punishable under Sections 379 of of IPC., and Section 41(1)(1A) and 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.139 of 2018, on the file of the respondent police, seek anticipatory bail.

2. This case involves 1⁄2 unit of sand theft.

3. The learned Government Advocate(Crl.Side) submitted that the first petitioner is not having any previous case. The second petitioner is having one previous case.

. Recording the submission made by the learned Government Advocate(Crl. Side), this petition is dismissed as against the second petitioner and this Court is inclined to grant anticipatory bail to the first petitioner with certain conditions. Accordingly, the first petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Sathur, Virudhunagar District, and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/

Magistrate concerned and on further condition that the first petitioner shall appear before the respondent police as and when required for interrogation. The first petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

5. The first petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
