Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 not to grant any permission to conduct the temple festival from 13.10.2020 to 20.10.2020 in the temple namely, "Sri Aaththimaram Periyasamy Thirukkovil" situated at Alathoor Village, Kulithalai Taluk, Karur District based on the petitioner's representation dated 04.08.2020.

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 5. Mr.J.K.Jayaselan, learned counsel, entered 1/3
appearance for the respondents 6 and 7. There is no appearance on behalf of the respondents 8 and 9. But considering the nature of relief to be granted, notice to the respondents 8 and 9 are dispensed with.
2.By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. 3.The petitioner is a resident of Alathoor Village. The petitioner states that the petition mentioned temple is being worshiped by 87 villages surrounding Alathoor Village. His grievance is that a section of the worshipers are excluded from worship. All that the petitioner wants is only the right to worship and that the petitioner is not asserting any other right. 4.I am of the view that, this right cannot be denied for any reason whatsoever. The petitioner states that if the petition mentioned temple is kept open every Friday evening from 06.00 p.m to 08.00 p.m, the petitioner shall be more than satisfied. No exception can be taken to this request.
I therefore, direct the fourth respondent to ensure that the petition mentioned temple is kept open on all the Fridays, particularly, from 06.00 p.m to 08.00 p.m. The fourth respondent will also prevail upon the temple management to ensure that on special occasions, such as marriage, the temple is kept open. The Poojari of the temple shall also be present. The official respondents will ensure that the right to worship by the petitioner and his Vagaiyara is not affected in any manner.
5.The writ petition is allowed on these terms. No costs.
