PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the first respondent herein to dispose the Petitioner's Appeal dated 16.03.2020 on the file of the first respondent herein in accordance with law.

ORDER

This Writ Petition is filed seeking for a direction, to direct the first respondent herein to dispose the Petitioner's Appeal dated 16.03.2020 on the file of the first respondent herein.

2. The learned counsel appearing for the petitioner would submit that the Special Deputy Collector, Virudhunagar District/second respondent herein passed an order under Section 41A(1) of Indian Stamp Act, on 03.11.2015. Against which, the petitioner has preferred an appeal along with condone the delay of 1053 days before the Inspector General of Registration (Stamps), Chennai/ first respondent, on 16.03.2020. Till then, no order has been passed. Hence, the petitioner filed the present Writ Petition to dispose of the appeal.

3.The learned Additional Government Pleader appearing for the respondents would submit that the said appeal is pending before the first respondent and the same would be considered and appropriate orders will be passed.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

5.Considering the submissions made on either side, without expressing any opinion on the merits of the case, this Court is inclined to directs the first respondent to consider the petitioner's appeal dated 16.03.2020 and pass appropriate orders on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as the interested parties, if any, within a period of twelve weeks from the date of receipt of a copy of this order.

6.This Writ Petition is disposed of, with the above direction. No costs.
