PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.556 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 341,294(b),323,324 and 307 of IPC , in Crime No.556 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 21.06.2021 the defacto complainant's uncle son Sakthiswaran came there to meet him. Then the defacto complainant and Sakthiswaran left in a car bearing Reg. No.TN 49 BZ 7979 to Mathukoor. When they are about to reach Mathukor at about 03.00 hrs the accused stopped the car. Both of them got down from the car and asked the accused persons why they stopped the car, for which the accused persons scolded them in filthy language. Manivanan and Roshan attacked him on his face.. When the defacto complainant intervened he was also attacked by Neethi with aruval. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would also submit that a counter case has been registered in Crime No.557 of 2021 for the offences under Sections 294(b) and 324 of IPC based on the complaint given by Neethirajan.

4. The learned Government Advocate(Crl.Side) opposed the petition on the ground that the investigation is not yet completed. It is also his submission that the petitioner is having one previous case in Crime No.119 of 2020 for the offence under Sections 302,341 and 342 of IPC.

5. Considering the nature of incident and the fact that one previous case is pending against the petitioner in Crime No.119 of 2020 for the offence under Section 302 of IPC, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Hence the petition stands dismissed.
