Respondents/Tenants Prayer : Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the learned Principal District Munsif (Rent Controller) Court, Tenkasi to dispose of the interlocutory application in I.A.No.8 of 2016 in R.C.O.P.No.28 of 2015, within time fixed by this Court by allowing this Civil Revision Petition.

ORDER

This Revision is filed seeking for a direction to the learned Rent Controller(Principal District Munsif), Thenkasi, to dispose of the I.A.No.8 of 2016 in R.C.O.P.No.28 of 2015 within a time frame.

2. Heard the learned counsel appearing for the petitioner and perused the records.

3. Mr. H.Arumugam, learned counsel for the petitioner would submit that the petitioner filed an eviction petition in R.C.O.P.No.28 of 2015 against the respondents on the grounds of willful default, own use and occupation. Despite the same, the respondents have not paid rents regularly. So, the petitioner filed I.A.No.8 of 2016 under Section 11(4) of Tamil Nadu Building Lease and Rent Control Act for a direction to pay the arrears of rents.

4. The learned counsel for the petitioner would further submit that though the application was filed in the month of January 2016, the respondents have been taking time for filing counter and https://hcservices.ecourts.gov.in/hcservices/

there is no progress in the application for about seven months and the respondents are abusing the process of law, causing miscarriage of justice to the petitioner.

5. Considering the above submissions of the learned counsel for the petitioner, the learned Rent Controller(Principal District Munsif), Thenkasi shall dispose of the application in I.A.No.8 of 2016 in R.C.O.P.No.28 of 2015 as expeditiously as possible, preferably on or before 31.10.2016.

6. With the above directions, the Civil Revision Petition is disposed of. No costs.
