This petition has been filed by the petitioner to direct the Page No. 1 of 4
Additional Mahila Court, Ramanahapuram to complete the trial in C.C.No.5 of 2023 within the time stipulated by this Court.
2. According to the petitioner, he is the 1st accused in this case and F.I.R has been registered against the petitioner and another accused in the year 2022. Now the case is pending for trial for the past three years without any progress. Hence this petition.
3. The learned Government Advocate (Criminal Side) appearing for the first respondent would submit that based on the complaint lodged by the 2nd respondent, they registered a case in Crime No. 88 of 2022 for the offences under Sections 294(b), 323 and 506(1) of IPC and Section 4 of TN Prohibition of Harassment of Women Act, 2002 and thereafter, they have filed the final report. Based on the final report, the trial Court had taken cognizance in C.C.No.5 of 2023 and the same is pending. Already, PW.1 to 3 witnesses were examined and now the case is posted for examination of other witnesses. However, they will cooperate for the speedy disposal of the case by producing the witnesses without any delay.
4. Considering the prayer sought for in the petition, this Court even Page No. 2 of 4
without issuing notice to the 2nd respondent inclined to pass orders in this petition.
5. This petition is filed by the petitioner for the speedy disposal of the case and now the case is posted for examination of further witnesses and some of the witnesses were already examined. Therefore, considering the long pendency of case, this Court directs the Trial Court to complete the trial in C.C.No.5 of 2023 on the file of the Additional Mahila Court, Ramanathauram as early as possible without giving long adjournments beyond one week.
6. With the above said observation and direction, this Criminal Original Petition is disposed of.
