ORDER

The above writ petition has been filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus thereby direct the respondents to release the petitioners Ashok Leyland Tipper Lorry bearing Registration Number TN 05 1117."

The facts as set out in the affidavit filed in support of the writ petition reads as follows:- The petitioner would submit that he is the owner of the vehicle (Ashok Leyland Tipper Lorry) bearing Registration No.TN 05 1117. The certificate of registration also stands in the name of the petitioner. While so, on 12.05.2022, the 2nd respondent police had seized the petitioner's vehicle alleging that the vehicle was used for illegal transportation of ration rice and the case was also registered in Crime No.76 of 2022 on 12.05.2021, for the offences punishable under Section 6(4) of the Tamil Nadu Scheduled Commodities (RDCS) Order, 1982 and Section 7(1)(a)(ii) of the Essential Commodities Act, 1955 against the petitioner and his son. 2/4

3. He would submit that the said vehicle has been kept in an open yard for the past two days, due to which the vehicle is losing its value. He would further submit that the 2nd respondent has not filed the Final Report till date and the vehicle has also not been produced before the concerned Jurisdictional Magistrate Court. Therefore, the petitioner has sent a representation dated 23.05.2022, however, the same has not been considered. Aggrieved by the same, the petitioner is before this Court.

The learned Government Advocate appearing for the 1st respondent and the learned Government Advocate (Crl.Side) appearing for the 2nd respondent would submit that the representation submitted by the petitioner dated 23.05.2022, will be considered and orders will be passed within the time stipulated by this Court.

5. In view of the above, the respondents are directed to consider the representation of the petitioner dated 23.05.2022 and pass final orders on its own merits and in accordance with law within a period of two (2) weeks from the date of receipt of a copy of this order. 3/4
