O R D E R

This petition is filed by the petitioner to quash the impugned order Na.Ka.No.34/Peraiyur Kaval Vattam/2025 dated 07.04.2025, on the file of the second respondent and consequently, direct the respondents to grant permission and police protection for the Adal Padal cultural program in the eve of Sri Muthalamman temple on 09.04.2025 at evening about 06.00 P.M. to 11.00P.M. on the basis of the representation given by the petitioner, dated 02.04.2025.

The learned counsel for the petitioner would submit that the petitioner is one of the member of the festival committee and villagers decided to conduct festival for the Sri Muthalamman temple, from 08.04.2025 to 09.04.2025. Therefore, they decided to conduct Adal Padal programme on 09.04.2025, due to which they approached the second respondent, through representation, dated 02.04.2025 for seeking permission, but the same was declined on the ground of law and order Page No. 2 of 6

issue. The petitioner undertakes to conduct Adal Padal programme without any law and order issue and the second respondent cannot deny to grant permission only on the ground of law and order issue. Therefore, the order passed by the second respondent is liable to be set aside.

The learned Additional Public Prosecutor (Crl side) for the respondents would submit that earlier, the petitioner sent a representation, dated 02.04.2025, for conducting Adal Padal programme on 09.04.2025 and the same was rejected on the ground of law and order issue. However, if the petitioner undertakes to conduct Adal Padal Programme without any law and order issue, they have no objection.

Considering the prayer sought for in this petition and the petitioner also undertakes to conduct cultural programme of Adal Padal without any law and order issue and the also respondents have no objection, this Court is inclined to set aside the order passed by the second respondent in Na.Ka.No.34/Peraiyur Kaval Vattam/2025, dated 07.04.2025.

5. In view of the same, this petition is allowed and the order passed Page No. 3 of 6

by the second respondent in Na.Ka.No.34/Peraiyur Kaval Vattam/2025, dated 07.04.2025, is set aside. The petitioner is permitted to conduct Adal Padal Programme on 09.04.2025 from 6.00 p.m. to 10.00 p.m.

6. The respondents are directed to provide adequate police protection and to monitor the entire event. If any deviations, the second respondent is at liberty to take action in accordance with law.

7. The petitioner also directed to ensure that without any law and order issue and without any obscene acts and also without praising any community people, the Adal Padal programme has to be conducted.

8. With the above said directions and observations, this Writ Petition is allowed.
