Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for records relating to the impugned sale certificate dated 07.06.2024 issued by the first respondent in favour of the 6th respondent registered as document No.2866 of 2024, on the file of the 4th respondent and consequential warrant of commission issued by the Chief Judicial Magistrate, Virudhunagar @ Srivilliputhur, in Crl.M.P.No.1968 of 2024, dated 01.03.2025, under Section 14 of the SARFAESI Act vide Advocate Commissioner's notice dated 02.04.2025 and quash the same and consequentially pleased to direct the 4th respondent to remove the document No. 2866 of 2024 from their file.

Petitioner may approach the Debts Recovery Tribunal. Since petitioner is actually impugning the order passed under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, we do not wish to exercise our jurisdiction under Article 226 of the Constitution of India. If petitioner approaches the Debts Recovery Tribunal within two weeks from today, delay, if any, shall be deemed to have been condoned.
