ORDER

The writ petition has been filed in the nature of Mandamus seeking a direction to the respondents, particularly the second respondent / District Revenue Officer, Madurai, to consider his representation dated 03.03.2023 given by the petitioner herein.

2.In the affidavit, filed in support of the petitioner, the petitioner had stated that the forefathers of the petitioner had established a temple called Arulmigu Kasi Visweswara and Vishalakshi Amman Temple in the land in survey No.25, Mullipallam, Vadipatti Taluk. However, there have been some encroachment in the said land.

3.The learned Special Government Pleader stated that the records would indicate that the aforementioned survey number is classified as Sivan temple. 2/4

Let the petitioner make a fresh representation to the second respondent herein and if a fresh representation is given to the second respondent and when a representation is received, the second respondent / District Revenue Officer, Madurai, is directed to issue notice to the petitioner herein and thereafter obtain a report from the Tahsildar, Vaidpatti Taluk, Madurai, about the nature of the land and direct the Tahsildar to give report about the occupants of the said land and on the basis of the said report, after following due procedure, pass necessary orders. The petitioner may give a fresh representation on or before 15.05.2023. The second respondent may, therefore, issue a necessary direction to the fourth respondent Tahsildar, Vadipatti Taluk, to do the necessary enquiry which should be completed on or before 31.08.2023 and thereafter the second respondent must pass orders on or before 31.10.2023.
