Respondent Prayer : This Civil Revision Petition is filed under Article 227 of the Constitution of India, to dispose of the Execution Petition in E.P.No.33 of 2016 in O.S.No.42 of 2007 on the file of the Subordinate Judge, Pattukkottai, within a time frame as may be fixed by this Court.

ORDER

This revision is filed seeking for a direction to the Sub Court, Puttukkottai, to dispose of the Execution Petition in E.P.No.33 of 2016 within a time frame.

2.Heard the learned counsel for the petitioner and perused the materials available on record.

3. Mr.S.Subbiah, learned counsel for the petitioner would submit that the petitioner instituted a suit in O.S.No.42 of 2007, against the respondent for declaration and recovery of possession and the suit was decreed on 02.09.2010. The defendant has not preferred any appeal against the decree. Hence, the decree passed in the suit has become final.

4. The learned counsel for the petitioner would further submit that the decree holder has filed an execution petition in E.P.No.33 of 2016 and it is being adjourned without any reason. The delay in disposal of the case causes great mental agony and hardship to the petitioner.

5. Considering the submissions of the learned counsel for the petitioner and without going into the merits of the case, the learned Sub Judge, Pattukkottai, is directed to dispose of https://hcservices.ecourts.gov.in/hcservices/

E.P.No.33 of 2016, as expeditiously as possible, preferably, not later than 31.12.2016.

6. With the above direction, this Civil Revision Petition is disposed of. No Costs.
