ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) The prayer sought for in this petition is to delete petitioner 3rd respondent herein Viz., The Joint Director of Handloom, Handloom Directorate Kuralagam, 2nd Floor, Chennai - 600004 from the cause title of the above writ petition on the ground of mis-joinder of parties. 2/6

2. The present petitioner has been made as 3rd respondent in the main writ petition.

3. The prayer sought for in the main writ petition is to remove the illegal construction in Survey Nos.91/1 and 99/7 situated at Mahalakshmi Colony, Thirunagar, Madurai.

4. Insofar as the said illegal construction is concerned, the learned Standing Counsel appearing for the Madurai Corporation would submit that already notice has been issued and whoever has made illegal construction that would be verified and if it is the illegal constriction, it would be removed in accordance with law. When that being the position, the Joint Director of Handloom, Chennai, since is no way connected with the prayer sought for in the main writ petition and he is not responsible for any alleged illegal construction made in the disputed site, the question of impleading him as one of the party in the writ petition does not arise as he is not a necessary party to be heard. 3/6

5. In view of the same, the present prayer is ordered. The 3rd respondent namely, The Joint Director of Handloom, Handloom Directorate Kuralagam, 2nd Floor, Chennai - 600004, is removed from the array of parties in the main writ petition.

6. Post the main writ petition for filing counter by the respondents within a period of four weeks.
