ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) and 25 of NDPS Act, in Crime No.122 of 2023 on the file of the respondent police, seeks anticpatory bail.
2. The case of the prosecution is that based on the secret information, the respondent police conducted raid along with his police party on 24.03.2023 from Kavandampatti burial ground and the accused persons were sitting bike bearing Registration NO.TN 58 BM 3177 Hero Passion bike in suspicious manner and when the respondent police enquired and searched, the accused persons are carrying a bag containing 1.200 kgs of ganja. Hence, the complaint.
3. Heard both sides and perused the materials available on record including the First Information Report.
4. On perusal of the records it revealed that the petitioner along with other accused persons were conscious and constructive possession of contraband weighing 1.200kgs and after seeing the police party, A3 escaped from the scene of occurrence. CRL OP(MD). No.7352 of 2023 Therefore, the custodial interrogation of the petitioner is very much required. Accordingly, this Criminal Original Petition is dismissed.
