For Respondent : Mr.SS.Madhavan, Government Advocate (Crl. side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :-For Anticipatory Bail in Crime No.138 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners/A.1 & A.2, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 323, 324 and 506(ii) of IPC, in Crime No.138 of 2022, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 21.05.2022, one Muthu has lodged a complaint before the respondent police alleging that due to existing dispute with regard to conduct of jallikattu between the petitioners' and the de-facto complainant's group, on 20.05.2022, a peace talk was going on, during the meeting, the petitioners abused the de-facto complainant by using filthy language and attacked him with hands and also threatened him with dire consequences.

4. The case of the petitioners is that in order to pacify the jallikattu dispute, on 20.05.2022, a meeting was convened by the village elders. During the meeting, the de-facto complainant with his companion abused the petitioners by using filthy language and assaulted them with deadly weapons and threatened them with dire consequences. The petitioners also lodged the complaint before the respondent police and the same was also registered in Crime No.139 of 2022. The petitioners also sustained injuries and the first petitioner only discharged yesterday.
5. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) and perused the materials available on record.
6. During the peace talk, there was a wordy quarrel arose between both the parties and also assaulted each other.
7. Considering the fact that this is a case in counter, both the accused in Crime Nos.138 and 139 of 2022 are directed to surrender before the learned Judicial Magistrate, Lalgudi, within a period of ten days from the date of receipt of a copy of this order and file a bail application before the Magistrate and if they file an application for bail, the learned Magistrate is directed to consider their bail application, on the same day and pass orders, in accordance with law.
8. With the above directions, this Criminal Original Petition is disposed of.
