PRAYER IN CRL RC(MD) No.146 of 2016 :

Pleased to allow this Criminal Revision and call for records relating to order passed by Learned Family Court, Madurai in Cr.M.P. No.61 of 2015 in Cr.M.P.No.114/2009 in M.C.No.28 of 1991, dated 29.10.2015 and set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MOHAN GANDHI.S.M., Advocate for the petitioner and of MR.A.HARIHARAN, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed seeking to modify the order passed in Crl.M.P.(MD)No.2206 of 2016 in Crl.R.C.(MD)No.146 of 2016, dated 14.03.2016.

2.It is seen from the records that this Court has passed conditional stay order in Crl.M.P.(MD)No.2206 of 2016, dated 14.03.2016 and directed the petitioner to pay a sum of Rs.4,000/- to the respondent towards maintenance from April 2009 onwards, by way of money order or demand draft and the entire arrears amount and the subsequent payments shall be paid on or before 10.05.2016 and thereafter, the future maintenance shall be paid on or before 10th day of every succeeding English Calendar month without fail and he was also directed to file an affidavit regarding the compliance of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.4535 of 2021 the said condition by the petitioner before the Registry and in the event of failure to comply with the said condition, the interim stay order shall stand vacated automatically.

3.The present application seeking modification of the said order came to be filed on 26.06.2021.

4.The learned counsel for the respondent would submit that the petitioner has not paid the arrears amount as directed by this Court.
