Respondents This Writ Petition has been filed praying for a writ of Mandamus directing the 1st respondent to direct the 3rd respondent to survey and fix the boundary marks in survey No.173/10, situated in Sundaram Village Ponnamaravathy Taluk Pudukkottai District based on the petitioner's representation dated 21.3.2014.

ORDER

This Writ Petition has been filed praying for a writ of Mandamus directing the respondents to survey and fix the boundary marks in Survey No.173/10, situated in Sundaram Village, Ponnamaravathy Taluk, Pudukkottai District, based on the petitioner's representation dated 21.3.2014.

2. Mr.S.Bharathi, learned Government Advocate takes notice for the respondents.

3. By consent, this Writ Petition itself is taken up final disposal.

4. The learned counsel appearing for the petitioner would submit that it would be suffice if the representation of the petitioner is disposed of on merits and in accordance with law within the time stipulated by this Court.

5. The learned Government Advocate appearing for the respondents has no objection in considering the request of the petitioner.

6. In view of the above, without going into the merits of the claim made by the petitioner in this Writ Petition, the second respondent is directed to survey and fix the boundary marks of the petitioner's property, by considering the representation of the petitioner, dated 21.03.2014, on merits and in accordance with law, after giving notice to the adjoining owners, within a period of six weeks from the date of receipt of a copy of this order. It is made clear that this order should not be construed as giving any positive direction to the second respondent who should pass orders depending upon the facts and circumstances of the case.

With the above direction, this Writ Petition stands disposed of. No costs.
