ORDER

This review application has been filed seeking to review the order passed by this Court in W.P(MD)No.31337 of 2024 by order dated 20.12.2024, thereby directed the first respondent herein to transfer the permits of the vehicles in the name of the second respondent herein, who is the wife of the deceased Nagarajan, within a period of two weeks. Further, the petitioner in W.P(MD)No.31337 of 2024 was granted liberty to probate the Will in the manner known to law. If he succeeds in the probation of Will, he can make an application before the first respondent therein for transfer of permit in his name.

2.Originally, the permit stood in the name of one Nagarajan. Subsequently he died. Even prior to the passing of an order in W.P(MD)No.31337 of 2024, dated 20.12.2024, the request for transfer of permit in the name of the deceased Nagarajan in respect of the mini stage carriages bearing Registration Nos.TN-01B-0367, TNP-7374 and one Toyata Qualis car bearing Registration No.TN-49-V-6585, was rejected by order dated 16.12.2024. However, the said fact was not brought to the notice of this Court at the time of passing order in the Writ Petition, dated 20.12.2024. 3.In view of the above, the order passed by this Court in W.P(MD)No.31337 of 2024 dated 20.12.2024 is hereby recalled and W.P(MD)No.31337 of 2024 is dismissed. However, the first respondent is at liberty to probate the Will in the manner known to law. If he succeeds in the probation of Will, he can make an application before the review applicants herein for transfer of permit in his name.
