Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent Nos.2 and 3 to speedy disposal in Na.Ka.AA2/658/2021, dated 04.05.2021, pending before the same and to issue a patta in favour of the petitioner by cancelling the free scheme patta issued to the respondents Nos.4 to 7 based on the petitioner's representation dated 25.01.2021.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the second and third respondents to dispose of Na.Ka.AA2/658/2021, dated 04.05.2021, within the time frame fixed by this Court, wherein, the petitioner is seeking for issuance of patta.

2. The case of the petitioner is that the subject property absolutely belongs to him and even the S.L.R and S.F.I stand in his name. The grievance of the petitioner is that the respondents 4 to 7 have managed to get a free scheme patta with respect to the property belonging to the petitioner. The petitioner, therefore, made a representation to the second and third respondents to cancel the patta and to issue patta in the name of the petitioner. Since the same was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions.

3. Heard Mr.PR.Boome Rajan, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Government Advocate appearing for the respondents 1 to 3.

4. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the second respondent to consider the representation made by the petitioner on 25.01.2021 after affording opportunity to the petitioner and the respondents 4 to 7 and deal with the same on its own merits and in accordance with law and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order.

6. This Writ Petition stands disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
