Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.E.SOMASUNDARAM, Advocate for the petitioner and of Mr.R.ANANDHARAJ, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- [Order of the Court was made by K.KALYANASUNDARAM, J.] This application has been filed to suspend the sentence imposed by the learned Principal Sessions Judge (Mahila Court), Pudukkottai, in S.C.No.28 of 2018, dated 03.08.2019.
2.This is the second application. The earlier application filed by the petitioner came to be dismissed only on 22.01.2020. The petitioner was charged and convicted for the offences punishable under Sections 5(l), 5(m) and 5(n) r/w Section 6 of Protection Of Child from Sexual Offences (POCSO) Act, 2012. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.4414 of 2020 3.This Court, taking note of the evidence of P.W.8-Doctor, dismissed the earlier application. Hence, we are of the opinion that there is no change in circumstances to consider this application at this stage.
