Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents herein to treat petitioner's temporary service period from 10.08.2000 to 01.09.2005 as qualifying service period and grant the petitioner's monthly pension under the Tamil Nadu State Transport Corporation Employees Pension Fund Scheme from the date of petitioners retirement i.e., 31.05.2025 by considering petitioner's representation dated 20.02.2026.

Mr.K.Ramaiah, learned Standing Counsel, takes notice for the respondents 1 to 4. Mr.S.C.Herold Singh, learned Standing Counsel, takes notice for the fifth respondent.
2. With the consent of both sides, this writ petition is disposed of at the admission stage.

3. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
4. The petitioner herein, who was temporarily appointed as Conductor on 10.08.2000, was made permanent and thereafter, the petitioner retired from service on 31.05.2025. According to the learned counsel for the petitioner, right from the date of his initial appointment on temporary basis, proper deduction has been made towards the pension contribution till the date of his retirement. But he has not been put under the Old Pension Scheme. Now, he has been fixed under the Contributory Pension Scheme on the ground that his service has been regularised after 01.04.2003. Hence, the petitioner claims to have submitted a representation dated 20.02.2026 requesting the payment of pension under Old Pension Scheme, but the said representation has not been considered by the respondents. Hence, he approached this Court by way of filing the present writ petition.
5. The learned Standing Counsel for the respondents 1 to 4 submitted that the third respondent is the proper authority to consider the 3/6
representation submitted by the petitioner.

In the light of the above, without going into the merits of the matter, this Writ Petition is disposed of directing the third respondent to consider the representation dated 20.02.2026 submitted by the petitioner and pass appropriate orders as expeditiously as possible, at any rate, within a period of eight (8) weeks from the date of receipt of a copy of this order. No costs.
