Respondents This Writ Petition has been filed praying for a writ of Mandamus directing the respondents herein to grant compensation together with interest and other charges for acquisition of her land measuring 10 cents of land in S.No.8/4 in Eilyarpathi Village, Madurai South Taluk, covered by patta No.440 as per her representation dated 30.05.2014 with a reasonable time.

ORDER

This Writ Petition has been filed praying for a writ of Mandamus directing the respondents herein to grant compensation together with interest and other charges for acquisition of her land measuring 10 cents of land in S.No.8/4 in Eilyarpathi Village, Madurai South Taluk, covered by patta No.440 as per her representation dated 30.05.2014.

2. Mr.S.Chandra Sekar, learned Government Advocate, takes notice for the respondents.

3. By consent, this Writ Petition itself is taken up final disposal.

4. The learned counsel appearing for the petitioner would submit that it would be suffice if the representation of the petitioner is disposed of on merits and in accordance with law within the time stipulated by this Court.

5. The learned Standing Counsel appearing for the respondents has no objection in considering the request of the petitioner.

6. A perusal of the representation would reveal that the land pertaining to the petitioner has been acquired for public purpose for which necessary compensation has not been paid to the petitioner. Therefore, the petitioner has made a representation on 30.05.2014 to the respondents seeking compensation. But, it did not evoke any response from the respondents.

7. In view of the above, without going into the merits of the claim made by the petitioner in this Writ Petition, the first respondent is directed to pass appropriate orders on the representation of the petitioner, dated 30.05.2014, on merits and in accordance with law, after giving notice to the interested parties, if any, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that this order should not be construed as giving any positive direction to the respondent who should pass orders depending upon the facts and circumstances of the case.

With the above direction, this Writ Petition stands disposed of. No costs.
