Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.M.SURESH, Advocate for the petitioner and of MR.P.KOTTAI CHAMY, Government Advocate (Criminal Side)on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition is filed seeking to modify the condition 1/3
imposed on the petitioner that he shall appear before the concerned trial Court every day till the disposal of the case in S.C.No.125 of 2021, while granting bail to the petitioner in Crl.O.P.(MD)No.22312 of 2023, dated 07.02.2024.
2. The learned counsel appearing for the petitioner submits that the petitioner is complying with the above condition regularly from 09.02.2024. He further submits that the petitioner is a coolie worker and in order to comply with the condition, he has to travel a long distance every day and he has to spend huge money for travelling. Due to the said condition, he finds it very difficult to go to work and earn money for his livelihood.
3. Considering the said submission, this petition is allowed and the condition imposed on the petitioner in Crl.O.P(MD) No.22312 of 2023 is modified to the effect that the petitioner shall appear before the trial Court on every Monday at 10.30 a.m. till the disposal of the case in S.C.No.125 of 2021. sd/- 03/06/2024 / TRUE COPY / /06/2024 Sub-Assistant Registrar (C.S.I /II /III /IV ) Madurai Bench of Madras High Court, Madurai - 625 023.
