O R D E R

This petition has been filed seeking a direction to the respondent to complete the investigation and to file the final report in Crime No.63 of 2021 on the file of the respondent Police before the concerned Court within the time stipulated by this Court.

2. During the course of arguments, the learned counsel appearing for the petitioner submits that the victim will attain majority in few months and the Police are waiting for the same and so that, they can take sides with the accused person and therefore, they are delaying with the investigation. Such contention cannot be accepted at this stage and this Court cannot decide as to whether the offences under POCSO Act are attracted or not and it is the duty of the Investigating Officer to decide the same.

3. At this juncture, the learned Additional Public Prosecutor requests this Court that one month time may be granted to complete the investigation and file final report before the concerned Court.

4. Considering the request made by the learned Additional Public Prosecutor, this Criminal Original Petition is disposed of, https://hcservices.ecourts.gov.in/hcservices/ 1/2
