Heard the learned counsel on either side.

2. The petitioner challenges the order of dismissal. The initial ground taken by the petitioner is without jurisdiction.

3. The learned Additional Government Pleader has demonstrated that during the relevant time common cadre was not constituted. Therefore, the ground urged by the petitioner is not sustainable. The learned Additional Government Pleader submitted that the impugned order is appealable.

4. The petitioner can very well approach the first 2/4

If the petitioner files an appeal before the first respondent within a period of four weeks from the date of receipt of a copy of this order, the first respondent shall entertain the same without reference to limitation and dispose the appeal on merits and in accordance with law, after issuing notice to the third respondent. I make it clear that I have not gone into the merits of the matter. This writ petition stands disposed of accordingly. No costs.
