PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent Nos.1,2 & 3 to consider and dispose of the petitioner's representation dated 01.01.2021 as expeditiously as possible within the time stipulated by this Court.

O R D E R

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents to consider the representation made by the petitioner on 01.01.2021, wherein, the petitioner has requested the society to vacate the premises and to settle the entire dues and damages.

2. The case of the petitioner is that he is the owner of the subject property. The front portion of the property was leased out to the Co-operative Society in the year 2002. The further case of the petitioner is that the Society had some problems with its employees and for the last three years, there has been no activity in the Society. The petitioner had sought for increase in the lease amount at the rate of Rs.4,000/- per month and this was also not paid by the Society. That apart, the petitioner also apprehends that lot of damages had been made and the Society has to pay the compensation for the same.

3. The petitioner in this regard made a representation on 01.01.2021 to the respondents and since the same was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.

4. Heard Mr.R.Anand, learned counsel appearing for the petitioner and Mr.R.Suresh Kumar, learned Government Advocate appearing for the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent to consider the representation made by the petitioner on 01.01.2021 and deal with the same on its own merits and in accordance with law and take a decision within a period of four (4) weeks from the date of receipt of a copy of this order.

6. The petitioner is directed to make a fresh representation to the first respondent along with all the relevant documents and also a copy of this order.

7. This Writ Petition stands disposed of with the above directions. No costs.
