Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondents 1 and 2 from in any way appoint or confirm the 3rd respondent as Anganwadi worker at Aruppampatti Anganwadi Centre, Nallamanar Kottai Village, Vedasandhur Taluk, Dindigul District and consequently, direct the respondents 1 and 2 to appoint the petitioner as Anganwadi worker at Aruppampatti Anganwadi Centre, Nallamanar Kottai Village, Vedasandhur Taluk, Dindigul District as she is the eligible candidate for the above said post, within the period stipulated by this Court.

O R D E R

The petitioner has come forward with the present Writ petition to issue a Writ of Mandamus, forbearing the respondents 1 and 2 from appointing or confirming the 3rd respondent as Anganwadi worker at Aruppampatti Anganwadi Centre, Nallamanar Kottai Village, Vedasandhur Taluk, Dindigul District and consequently, direct the respondents 1 and 2 to appoint the petitioner as Anganwadi worker at https://hcservices.ecourts.gov.in/hcservices/

Aruppampatti Anganwadi Centre, Nallamanar Kottai Village, Vedasandhur Taluk, Dindigul District as she is the only eligible candidate for the above said post, within a time limit. 2.It is represented that the third respondent was appointed to the above said post. According to the petitioner, even though the third respondent was residing in the same place, she got married and that she is residing at Karur District for more than 10 years and by using her influence, the third respondent has got appointment to the said post.

3.Since the petitioner has sought for mandamus in the present Writ petition, such relief cannot be granted. Hence, it is open to the petitioner to challenge the appointment of the third respondent. Further, the respondents concerned are directed to furnish a copy of the appointment order issued to the third respondent to the petitioner within a period of one week from the date of receipt of a copy of this order. The Writ petition is dismissed accordingly. No costs. Consequently, connected W.M.P.is closed.
