Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records passed by the first respondent in No.853/thaku.2/2026 dated 13.03.2026 and quash the same as bad in law and further direct the respondent Nos.1 and 2 to grant emergency leave without escort for the period of six days to the petitioner's father, namely, Sivakumar S/o.Kalimuthu (C.P.No/6149 (PID No.377041) who is life sentenced prisoner in a POCSO Case and languishing in Madurai Central Prison for the past five years by considering the petitioner's representation dated 09.03.2026. [Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the proceedings of the the first respondent made in No.853/thaku.2/2026 dated 13.03.2026.

2. Heard the learned counsel on either side.

3. The petitioner has sought for grant of emergency leave on the ground that some arrangement must be made for the marriage of his son. The reason that has been assigned by the petitioner is not a ground for granting emergency leave as per the Rules. Therefore, the same has been rightly rejected by the first respondent.

4. The learned counsel appearing for the petitioner in the course of arguments submitted that there are sufficient grounds for grant of emergency leave.

5. The ground that has been raised in the present case is not one of the ground that has been provided under the Rules. If there are any other grounds for the petitioner to seek for emergency leave, a fresh representation can be made before the respondents which will be considered on its own merits and in accordance with law.

6. Except giving this clarity, no further orders can be passed in this petition.

7. This Writ Petition (Criminal) is disposed of in the above terms.
