Respondent/Respondent/PetitionerLandlord This Civil Revision Petition filed under Section 25 of the Tamil Nadu Buildings(Lease and Rent Control) Act, 1960 praying this Court to set aside the fair and decretal order made in R.C.A.No.2 of 2008, dated 8.2.2016, on the file of the Rent Control Appellate Authority(Principal Sub-Court), Tirunelveli confirming the fair and decretal order made in R.C.O.P.No.9 of 2006, dated 28.3.2007, on the file of the Rent Controller(Principal District Munsif),Tirunelveli. DECREE : This Civil Revision Petition coming up for hearing on this day. Upon perusing the Grounds, the Judgment and Decree of the Lower Appellate Court and the Court of First instance and the material papers and the Undertaking affidavit dated 25.11.2016 duly attested by the parties, upon hearing the arguments of Mr.H.Arumugam, Advocate for the petitioner and of Mr.M.P.Senthil, Advocate for the Respondent, this Court while disposing the Civil Revision Petition upon the undertaking of the parties, doth order and decree as follows;

i) that in view of the undertaking affidavit dated 25.11.2016 filed by the petitioner/tenant, the petitioner/tenant be and hereby is directed to vacate the petition schedule mentioned premises on or before 31.12.2017 and hand over vacant possession of the same to the first Respondent/landlord on 31.12.2017.

ii) that as undertaken by the learned counsel for the petitioner, the petitioner be and hereby is directed to pay Rs.1500/- as monthly rent from 01.01.2017 to 31.12.2017 on or before 5th of every successding English Calender month. iii) That the undertaking affidavit dated 25.11.2016 filed by this petitioner/tenant will form part of the decree. iv) that there be no costs in this Civil Revision Petition. sd/- Assistant Registrar (CO) / TRUE COPY / Sub-Assistant Registrar (C.S.)
