O R D E R

[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The petitioner has filed this habeas corpus petition seeking a direction to the respondents to secure his wife, namely, Durgadevi, aged about 25 years, produce her before this Court and set her at liberty.

2. It is the case of the petitioner that his wife is found missing from 01.03.2024. Since he was unable to trace her whereabouts, he lodged a complaint on 11.04.2024 before the second respondent - Police and it has been registered in C.S.R.No.236 of 2024. However, subsequently, no action has been taken by the respondent - Police to trace his wife. Hence, he has filed this habeas corpus petition.

3. Today, when the matter is taken up for hearing, learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that it is a case of elopement. The petitioner's wife had earlier eloped twice and based on the complaints given by the petitioner, two first information reports were registered and his wife was secured and handed over to the petitioner. Now, based on the complaint given by the petitioner, an enquiry is being conducted and as and when the whereabouts of the wife of the petitioner is traced, it would be informed to the petitioner.

4. Recording the above submission of the learned Additional Public Prosecutor, the habeas corpus petition is closed with a direction to the respondent - Police to continue with the enquiry in accordance with law and as and when the detenue is secured or her whereabouts are identified, the same shall be intimated to the petitioner forthwith.
