Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order vide Na.Ka.No.139/CAMP/SDOP/2022 dated 18.05.2022 passed by the first respondent and quash the same as illegal and consequently directing the first and second respondents to grant necessary permission and provide adequate police protection for conducting Paattu Kacheri on 28.05.2022 from 07.00 PM to 11.00 PM and Aadal Paadal on 29.05.2022 from 07.00 PM to 11.00 PM at Sundaresapuram Village, Kadayanallur Taluk, Tenkasi District as part of annual temple festival of Arulmigu Kaliamman Temple and Karuppasamy Temple. O R D E R
This Writ Petition has been filed challenging the impugned order vide Na.Ka.No.139/CAMP/SDOP/2022, dated 18.05.2022 passed by the first respondent and to quash the same as illegal and consequently, direct the respondents 1 and 2 to grant necessary permission and provide adequate police protection for conducting Paattu Kacheri on 28.05.2022 from 07.00 PM to 11.00 PM and Aadal Paadal on 29.05.2022 from 07.00 PM to 11.00 PM at Sundaresapuram Village, Kadayanallur Taluk, Tenkasi District as part of annual temple festival of Arulmigu Kaliamman Temple and Karuppasamy Temple.
2. Heard the learned counsel on either side.
3.The petitioner has sent a representation on 20.05.2022 and the first respondent has also received the same and passed rejection https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.10493 of 2022 order on 23.05.2022, but the reason stated in the rejection order is obvious and without any valid reason or without any particulars or statistics, the first respondent rejected the representation with flimsy reason, which is highly unwarranted.
4.Therefore, the rejection order passed by the first respondent, dated 18.05.2022, is set aside and the first respondent is directed to grant permission to the petitioner to conduct Paattu Kacheri on 28.05.2022 from 07.00 PM to 11.00 PM and Aadal Paadal on 29.05.2022 from 07.00 PM to 11.00 PM at Sundaresapuram Village, Kadayanallur Taluk, Tenkasi District as part of annual temple festival of Arulmigu Kaliamman Temple and Karuppasamy Temple with reasonable restrictions and in case of any necessity, send the second respondent or any other policemen from the Chokkampatti Police Station, Tenkasi District to monitor the cultural programme. 5.The first respondent is directed to appear before this Court on 26.05.2022 at 12.00 Noon.
6.With the above direction, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
