O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed for the issue of writ of mandamus directing the first respondent to grant six days emergency leave without police escort to the petitioner's son, who is a life convict, undergoing sentence at Central Prison, Trichy.

2. Heard the learned counsel on either side.

3. The learned counsel appearing for the petitioner submitted that the representation before the first respondent seeking for emergency leave on the ground that the sister of the life convict is facing a serious medical

issue and is critically ill, which requires an immediate attention. The first respondent has granted emergency leave for six days through proceedings dated 24.03.2026, but, however imposed a condition that the detenu will be accompanied with an escort. This condition has been put to challenge in the present petition.

Taking into consideration the facts and circumstances of the case and also considering the fact that the detenu was also granted 28 days ordinary leave earlier where the detenu had complied with the condition and nothing untoward took place and also considering the reason for which the emergency leave has been sought for, this Court is inclined to modify the condition to the effect that the detenu shall report before the third respondent every day at 06.00 p.m., during the entire emergency leave period. Apart from that condition, the detenu is permitted to execute the sureties before the Superintendent of Prison, Trichy, instead of executing the sureties before the Tahsildar and two sureties shall be the family members of the detenu. The other conditions imposed by the first respondent shall stand as it is.
