2 W.P.Crl.(MD)NO.1832 OF 2026 Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the first respondent vide proceedings in No.17291/ThaKu.4/2025 dated 23.12.2025 and quash the portion of the ordinary leave for 40 days granted with condition to execute the two sureties before the Tahsildar, Srirangam Taluk, Trichy and consequently direct the first respondent to grant 40 days ordinary leave without police escort the petitioner's husband namely Suresh, S/o.Nagarajan, aged about 46 years, life convict prisoner, PID No.2168 confined at Central Prison, Trichy.

O R D E R

(Order of the Court was delivered by G.R.SWAMINATHAN, J.) Heard both sides.

2. The petitioner's husband is undergoing life sentence in Central Prison, Trichy. He had so far spent 15 years in prison. He is entitled to 40 days ordinary leave. The prisoner was granted the said leave by the prison authority. However, a condition has been 2/3

3 W.P.Crl.(MD)NO.1832 OF 2026 stipulated that the sureties must execute bond before the jurisdictional Tahsildar. Since the Tahsildar would be busy with election duty, the petitioner seeks modification of the said condition.

3. There is no objection to this request. We modify the impugned order and permit execution of sureties before the second respondent.

4..The writ petition is allowed on the following conditions:- (a)The convict-prisoner, Suresh, (Convict No. 2168) now detained at Central Prison, Trichy is granted emergency leave for forty (40) days from 08.04.2026 to 17.05.2026 without escort.

(b) The convict prisoner shall be released from the prison at 10.00 A.M on 08.04.2026 and he shall return to the prison at 05.00 p.m., on 17.05.2026. (c) During the said leave period, he shall report before the Inspector of Police, Kollidam police station, Trichy District daily at 6:00 p.m, from 09.04.2026 onwards, without fail.

4 W.P.Crl.(MD)NO.1832 OF 2026 (d) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
