... Contemnor/ 1st Respondent PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act, to punish the respondent herein for his wilful disobedience of the order of this Court in W.P(MD) No.27862 of 2024, dated 21.11.2024.
For Petitioner : Mr.M.Mohana Sundaram For Respondent : Mrs.D.Farjana Ghoushia Special Government Pleader
ORDER
The present Contempt Petition has been filed alleging violation of the orders of this Court dated 21.11.2024 made in W.P(MD) No.27862 of 1/4
2024, wherein, this Court has directed the first respondent herein to pass final orders in the disciplinary proceedings within a period of eight weeks from the date of receipt of a copy of the order.
2. According to the learned Special Government Pleader appearing for the respondent, though the enquiry report has been submitted to the first respondent, the Enquiry Officer has not taken into consideration the audio clips, which are against the writ petitioner. Unless the writ petitioner appears for voice sample before the competent authority, the first respondent would not be in a position to take a final decision on the enquiry report submitted by the Enquiry Officer.
3. The learned Special Government Pleader appearing for the respondent further submits that at least three notices have been sent to the writ petitioner calling upon him to appear before the competent authority for voice sample but citing the pendency of the writ petition he is not appearing before the concerned authority. 2/4
4. It is the further submission of the learned Special Government Pleader that, in case, if the voice samples are found to be that of the writ petitioner, they would have to take a decision to deviate from the enquiry report.
5. In view of the above said facts, the respondent cannot be found fault with for not passing final orders within a period of eight weeks. In such view of the matter, this Contempt Petition stands closed. However, the petitioner is at liberty to challenge the notices issued to him to appear for giving voice samples, if he is so advised. 10.06.2025 Index : Yes/No Internet : Yes/No NCC : Yes/No ebsi To The Transport Commissioner, Chepauk, Chennai.
