ORDER

This writ petition has been filed to quash the impugned order issued by the first respondent in Muu.Mu.No.C4/1778625/2024 dated 13.02.2025 and consequential direction to the respondents herein to renew the petitioner's cracker shop license No.LE5-02/1992 in respect of petitioner's cracker shop which is situated at No.666, Madurai -Trichy Main Road, Nondikovil Street, Melur Town, Madurai District on the basis of recommendation given by the respondent/ Tahsildar dated 21.08.2024 in Na.Ka.No.1402/2024/A2 for the period of further two years.

It is the case of the petitioner that he has been running the crackers shop in the name and style of 'Harry Pattasu Shop' at No.666/W18, Main Road, Nondikovil Theru, Melur Town, Madurai District, since 1992 onwards. For running the crackers shop in the said premises, he had been granted license for storing and retail selling of the crackers vide proceedings of the respondent 2/6

bearing License No.LE5-02/1992 dated --.06.1995. The said license was periodically renewed once in two years upon inspection.

3. Even in the year 2022, the respondents had granted renewal of license for a period of two years from 01.04.2022 to 31.03.2024 by order dated 27.09.2022. Since the license was about to expire on 31.03.2024, the petitioner had submitted an application with necessary fees for renewal. After receiving the said renewal application, the second respondent sent his recommendation to the first respondent. On the basis of such recommendation, the first respondent has conducted an inspection of the petitioner's shop on 13.09.2024 and thereafter, has issued a show cause notice to the petitioner on 16.09.2024 alleging certain irregularities in running the shop. The petitioner has thereafter explained to the show cause notice and thereafter also, the petitioner's license was not renewed. Hence, the petitioner sent representation on 27.09.

2024 explaining all the facts. Under this circumstances, the first respondent without considering the petitioner's representation, has issued the impugned proceeding dated 04.10.2024 rejecting the petitioner's request for renewal. Under the impugned order, the respondents particularly stated that a readymade textile has been running in the first floor. Aggrieved over the same, the petitioner is before this Court.

On 13.10.2025, this Court had directed the petitioner to file an affidavit before the first respondent stating that the readymade shop which was running on the first floor has been vacated and the same is kept vacant. As directed, this petitioner has filed such affidavit before the first respondent. Therefore, the only reason for rejecting hte petitioner's application no longer exists.

5. In view of the same, the impugned order passed by the first respondent in Muu.Mu.No.C4/1778625/2024, dated 13.02.2025 is quashed and this Writ Petition is allowed. The respondents are directed to renew the petitioner's license forthwith, if it is otherwise in order. No costs. Consequently, connected Miscellaneous Petitions are closed.
