J U D G M E N T

[Judgment of the Court was made by S.M.SUBRAMANIAM, J.] This writ appeal is directed against the order of the learned Single Judge, dated 22.06.2021, passed in W.P.(MD) No.10433 of 2021.

2. Learned counsel appearing for the first respondent brought to our notice that during the pendency of this writ appeal, arbitration clause was invoked by the respective parties on the very same issue and the Arbitrator adjudicated the issue and passed an award and being not satisfied with the award passed by the Arbitrator, an Arbitration Original Petition No.658 of 2022 has been instituted, which is now sub judiced by the Principal Bench of this Court.

3. In view of the above submission, reserving the rights of the parties to the lis to adjudicate their rights in the pending arbitration original petition, this writ appeal is closed. No costs. Consequently, connected miscellaneous petition is closed.
