Prayer in WP(MD). 7203/2022 :

To issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the 2nd respondent dated 24.02.2022 and quash the same and consequently direct the respondents to allow the petitioner to continue his course. ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.PT.RAMESH RAJA, Advocate for M/S.I.KARTHIKEYA VENKITACHALAPATY, Advocate for the petitioner and of MR.S.SHAJI BINO, Special Government Pleader on behalf of the 1st Respondent and MR.P.P.ALWINBALAN, Advocate for the 2nd Respondent, the court made the following order:- The prayer sought for herein is for a direction to the respondents to receive the final year project from the petitioner.

2. The petitioner is ready with a final year project report, which the petitioner wants to submit to the second respondent college, however, since have not been received it, the petitioner has moved this petition.

WMP(MD) No.7626 of 2022 3.Heard Mr.PT.Ramesh Raja, learned counsel appearing for the petitioner, Mr.S.Shaji Bino, learned Special Government Pleader appearing for the first respondent and P.P.Alwinbalan, learned counsel appearing for the second respondent college. 4.The learned counsel appearing for the second respondent college submitted that there is an enquiry conducted against the petitioner and within a period of ten days, final order would be passed on such an enquiry. More over, for accepting the final year project report, the petitioner ought to have filed on or before 24.05.2022. There must be necessary attendance accrued in the account of the petitioner, without which the final project cannot be accepted by the College.

5.Be that as it may, the petitioner now made an attempt to file the final year project report, which can be received by the second respondent management and they can decide it whether the said report can be accepted or not based on the attendance particulars as well as the decision to be made on the disciplinary proceedings for which final order to be passed by the respondent college within ten days. 6.In that view of the matter, there shall be a direction to the second respondent college to receive the final year project report from the petitioner forthwith.

However, the receipt of such report will not automatically entail the petitioner to claim any right over it because whether the petitioner is entitled to submit such report based on the attendance and also depending upon the out come of the disciplinary proceedings, which has already been concluded is to be decided based on the order to be passed on the disciplinary proceedings by the second respondent College. 7.With this direction, this petition is ordered accordingly. sd/- 27/05/2022 / TRUE COPY / 28/05/2022 Sub-Assistant Registrar (C.S.)
