Respondents Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 3 to relieve the petitioner from the post of Junior Scientific Officer in the Tamil Nadu Forensic Sciences Department soas to enable the petitioner to join the fourth respondent Board as Environmental Scientist inpursuance of the provisional selection list dated 26.04.2022 within a timeline stipulated by this Court. ORDER
The petitioner is working as Scientific Officer in the Tamil Nadu Forensic Sciences Department under the first respondent.
Subsequently, he has been selected and appointed as Environmental Scientist at the fourth respondent, namely, Tamil Nadu Pollution Control Board. In the said office, the petitioner has to report for joining duty on or before 31.05.2022. Therefore, enabling the petitioner to join in the new position, when he makes a request to the present employer, that is, the Forensic Sciences Department to relieve him, the said plea since has not been considered, he has approached this Court with the aforestated prayer. 2.Heard Mr.C.Narendran, learned counsel appearing for the petitioner and Mr.S.Shaji Bino, learned Special Government Pleader appearing for the respndents 1 to 3 and perused the materials placed before this Court.
3. In view of the said plea raised by the petitioner, where he wants the relieving order so that he can join duty in the new appointment made at the fourth respondent Board, the plea of the petitioner may be considered and immediate orders may be passed in accordance with law.
4. In that view of the matter, this Court is inclined to direct the first respondent and his subordinates, namely, the second and third respondents, as the case may be, to take action on the plea of the petitioner for relieving him enabling him to join as Environmental Scientist at Tamil Nadu Pollution Control Board/fourth respondent on or before 31.05.2022. In this regard, the petitioner's representation, dated 28.04.2022 shall be considered objectively and orders shall be passed as indicated above.
