RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the condition imposed in Crl.O.P.No.5762 of 2020 on 08.06.2020 and permit the petitioner to pay a sum of Rs.5000 as maintenance to the De-facto complainant in the case in Crime No.04 of 2020.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.JOTHI BASU, Advocate for the petitioner and of Mr.A.ROBINSON, Government Advocate (Crl.side) on behalf of the Respondent, the court made the following order:- Heard the learned counsel on either side.
2.The petitioner was granted anticipatory bail on condition that he should pay a sum of Rs.7,500/- to his wife. The petitioner seeks modification of the said condition. This is because, the petitioner has been suspended vide order dated 21.08.2020. The petitioner's counsel states that now the petitioner is getting only Eleven Thousand Rupees per month. Therefore, the earlier condition is modified and the petitioner is permitted to pay Rs.5,000/- (Rupees Five Thousand only) per month to his wife. However, this modification will hold good, only till the suspension is revoked. https://hcservices.ecourts.gov.in/hcservices/
After the suspension is revoked and the petitioner is reinstated, the earlier order will automatically get restored. 3.This Petition is allowed accordingly.
