The petitioner has come forward with this Writ Petition seeking a Writ of Mandamus to forbear the respondents from allotting the Doubling Conversion work from the second respondent cooperative spinning mills limited namely Anna Co-operative Spinning Mills Limited to anyother person without calling for tenders, as per
the Transparency of Tenders Act based on the petitioner's representation dated 13.04.2015 2.
Notice was ordered by this Court on 17.04.2015 and private notice was also permitted.
3. Upon notice, the learned Govt.Advocate, through his counter affidavit would submit that the representation of the petitioner dated 13.04.2015 was received by the respondents on 15.04.2015. Before the respondents could act on the representation of the petitioner, without giving breathing time to the respondents, immediately, the petitioner has rushed to this Court by filing the present Writ Petition on 16.04.2015. Therefore, he prayed for the dismissal of this Writ Petition.
4. Thought the learned Counsel for the petitioner did not refute the submission of the learned Counsel for the respondents, he seeks indulgence of this Court to consider the representation of the petitioner within the time stipulated by this Court.
5. In view of the above, without going into the merits of the claim made by the petitioner in this Writ Petition, the second respondent is directed to consider the said representation of the petitioner dated 13.04.2015, on merits and in accordance with law, after providing an opportunity of hearing to the petitioner as well as any interested parties and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order.
With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
