ORDER

This Criminal Original Petition is filed to withdraw and transfer the investigation in Crime No.601 of 2023 on the file of the second respondent to the third respondent.

2. The learned counsel for the petitioner submitted that the petitioner is the de-facto complainant and the wife of one Rathinasabapathy who had died under suspicious circumstances on 28.08.2023 in an accident, for which a case in FIR No.601 of 2023 was registered for the offences under Sections 279 and 337 of IPC. There is no progress in the investigation and hence this Criminal Original Petition is filed.

3. Learned Government Advocate on instructions submitted that the FIR has already been closed as charges abated, since the investigation revealed that the death of the deceased was an accident due to self falling.

4. However, the learned counsel for the petitioner submitted that the death of her husband is not due to the self fall. One police namely 2/5

Rajapugalendhi, who came in a vehicle bearing registration No.TN 68 AJ 8928 Suzuki Access 125 near Ambasamudram, had suddenly stopped the vehicle without indicating the same, to attend a phone call. Pursuant to which the petitioner had dashed against the two wheeler, fallen down and had died. In this regard, the respondent police has not conducted an investigation in proper manner and hence sought for the indulgence of this Court.

5. Heard either side and carefully perused the materials available on record.

Considering the representation made by the petitioner on 08.09.2023 and the submission of the learned counsel for the petitioner, this Court directs the second respondent to reopen the case, which was closed as charges abated in Crime No.601 of 2023 and conduct further investigation in the matter in view of the petitioner's representation dated 08.09.2023. The first respondent is directed to monitor the investigation in this case and the second respondent is directed to appraise the progress of the investigation to the first respondent every Friday. 3/5

7. With the above directions, this Criminal Original Petition is allowed.
