PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent Nos.1 to 4 to disburse the amount of Rs. 1,04,22,587/- (One Crore Four Lakh Twenty two thousand Five Hundred and Eighty seven rupees only) for the supply of hardware and building materials for the work completed by the respondent Nos. 1 to 4, with 12% per interest per annum.

ORDER

This writ petition has been filed seeking a direction to the respondents 1 to 4 to disburse the amount of Rs.1,04,22,587/- (One Crore Four Lakh Twenty two thousand Five Hundred and Eighty seven rupees only) for supply of hardware and building materials for the work completed by the respondent Nos. 1 to 4, with 12% per interest per annum.

2. By consent of both parties, this writ petition is disposed at the stage of admission itself. Considering the nature of the order going to be passed in this writ petition, notice to the fifth respondent is dispensed with. 2/6

3. The case of the petitioner is that the petitioner is doing the business of supplying building materials and the fourth respondent issued the work order to the petitioner and the work was also completed. The fourth respondent also passed an order to release the amount spent by the petitioner. Hence, the petitioner made a representation dated 17.03.2025 seeking disbursal of the said amount. However, the same has not been disbursed till date. Hence, this writ petition came to be filed.

4. When the matter is taken up for hearing, the learned Special Government Pleader and the learned Additional Government Pleader appearing for the respondents 1 to 4 submitted that the case of the petitioner is under consideration and appropriate orders will be passed within a period of three months.

5. Recording the submissions made by the learned Special Government Pleader and the learned Additional Government Pleader appearing for the respondents 1 to 4, this Court directs the respondents 1 to 4 to consider the case of the petitioner on merits and pass appropriate orders disbursing the eligible amount to the petitioner in accordance with law, within a period of three months from the date of receipt of a copy of this order. 3/6

6. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
