For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.27/2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner is facing charges under Sections 294(b), 323 and 506(i) IPC and Section 4 of the Prohibition of the Harassment Act of Women Act, 2002 in Crime No.27 of 2022 on the file of the respondent police.
2.It is a case and counter. On the basis of the complaint given by the defacto complainant, the present case has been registered arraying two persons including one unidentified person as accused. Insofar as the counter case in Crime No.26 of 2022 is concerned, totally three persons have been arrayed as accused including one unidentified person. It appears that because of the previous enmity, on 15.05.2022 at about 08.00 pm., trouble has arisen between the two groups of people and there were exchange of words between them. 3.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that no one is injured in both the cases and no previous bad antecedents is reported against the petitioner. 4.Considering the fact that no one is injured in both the occurrences and no previous bad antecedents is reported against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner.

CRL OP(MD). No.9660 of 2022 5.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Singapunari, Sivaganga District, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
