O R D E R

The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to grant permission and protection to conduct the Chithirai Kodai Festival on 02.05.2023 and 03.05.2023 of the Arulmigu Sri Kaliamman Temple situated at Keela Nalatha Village, Thiruvengadam Taluk, Tenkasi District, consider the petitioner's representation dated 13.04.2023.

2. Mr.B.Nambiselvan, learned Additional Public Prosecutor takes notice for the respondents No. 1 and 2. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The learned Additional Public Prosecutor would submit that they have resolved the issue between the two groups of people and the proceedings were taken into account by the Executive Magistrate, Thiruvengadam. In the Peace Committee Meeting, both the parties namely this petitioner and as well as the rival parties participated. Due to continious issue between the two groups of people, it was resolved that for the present year, celebration of the temple festival need not be 2/4

undertaken. But however, both the parties must elect four persons as Managing Committee to conduct the above said festival. But the petitioner's party refused to accept the above said resolution and walked out of the meeting and other parties namely B-Party accepted the same.

4. The learned counsel for the petitioner would submit that they are ready to abide the above said resolution.

5. If it is so, the petitioner is directed to comply the above said resolution No.2 with the B-Party. The joint undertaking shall be given by both the partes before the second respondent. The second respondent is directed to consider the joint undertaking made by the parties and pass appropriate orders.

6. With the above direction, this Writ Petition stands disposed of No costs.
