This Criminal Original Petition has been filed to direct the learned Judicial Magistrate, Musiri to dispose of the case in C.C.No. 153 of 2023 within the stipulated period.
2.According to the petitioner, the petitioner is the defacto complainant in this case. Based on his complaint, a case has been registered by the respondent police in Cr.No.108 of 2022 against the accused persons. Though the case has been registered in the year 2022, so far case is pending without any disposal. Therefore, seeks for speedy disposal this petition has been filed.
3.The learned Government Advocate (Crl.Side) would submit that based on the complaint of the petitioner, a case has been registered in Cr.No.108 of 2022 for the offence punishable under Sections 294(b), 323, 324, 506(2) IPC. After completion of investigation, they have filed the charge sheet before the concerned Court. The case is posted for examination of witnesses 1 to 5. However, the respondent police is ready to produce the witnesses as directed by the trial Court and co-operate to complete the trial 2/4
proceedings.
4.Considering the limited scope of the prayer sought for by the petitioner and also considering the long pendency of the case, this Court hereby directs the learned Judicial Magistrate, Musiri to complete the trial proceedings in C.C.No.153 of 2023 as early as possible without giving long adjournments, beyond 1 week.
5.With the above direction, this Criminal Original Petition stands disposed of.
