ORDER

This petition has been filed seeking for a direction to the 1st and 2nd respondents herein to initiate appropriate legal action based on the petitioner's complaint dated 09.03.2026 and registered with CSR No.97/2026, against the borrower for unlawful trespass into the petitioner's property within a time frame fixed by this Court.

2. The learned counsel appearing for the petitioner submitted that the petitioner had purchased the subject property from the 6th respondent bank in SARFAESI proceedings through a public auction. However, respondents 3 to 5, who had availed a loan from the 6th respondent bank, are hindering the petitioner from taking possession of the property. In this regard, a complaint has been given and a CSR has also been issued; however, no action has been taken. 2/4

3. The learned Government Advocate appearing for the respondent police submitted that summons have already been issued to respondents 3 to 5, and the matter is pending.

4. Heard the learned counsel on either side and carefully perused the materials placed before this Court. Considering the nature of the order proposed to be passed in this petition, notice to the private respondents is dispensed with.

5. Considering the facts and circumstances of this case, the second respondent police is directed to conclude the enquiry, on the petitioner's complaint dated 09.03.2026 which was registered in CSR No.97/2026, after issuing summons to the parties concerned, under Section 64 of the BNSS, 2023 within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed. 06.04.2026 NCC : Yes / No Index : Yes / No sm 3/4
