Respondent/Respondent/Petitioner/ Landlord PRAYER:- This Petition is filed under Section 115 of the Code of Civil Procedure, to set aside the judgment and decree dated 30.11.2020 made in R.C.A.No.21 of 2016 on the file of the Rent Control Appellate Authority/Principal Subordinate Court, Madurai, confirming the judgment and decree dated 23.03.2016 made in RCOP.No.102 of 2009 on the file of the Principal Rent Controller (Principal District Munsif Court), Madurai Town, pending disposal of the above civil revision petition.

ORDER

When the matter is taken up for hearing, the learned counsel appearing for the petitioner has filed an affidavit of undertaking before this Court, wherein, it has been stated as follows:- "1.I am the petitioner in the above Civil Revision Petition and as such I am well acquainted with the facts of the case.

2.I submit that I have filed the above Civil Revision Petition challenging the eviction order dated 30.11.2020 made in R.C.A.No.21 of 2016 on the file of the Rent Control Appellate Authority, Madurai confirming the order dated 23.03.2016 made in RCOP.No.102 of 2009 on the file of the Principal Rent Controller, Madurai Town. 3.I submit that now I hereby agree and undertake to vacate and hand over the vacant possession of the demised premises to the respondent/landlord on or before 01.06.2022."

C.R.P.(MD) No.1412 of 2021 2.The affidavit is taken on file and the Civil Revision Petition is disposed of recording the undertaking that the petitioner will vacate the property on or before 01.06.2022. It is needless to state that he will continue to pay rent without any default. No costs. Consequently, connected miscellaneous petitions are closed.
