Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Writ Petition filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the respondents to give permission to the Petitioner to visit Germany for a period of 1 month from 01.05.2022 to 31.05.2022 on the basis of petitioner representation dated 12.04.2022.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.K.Samidurai, Advocate for the Petitioner and of Ms. L.Victoria Gowri, Assistant Solicitor General 1/3
of India for the respondents, this Court made the following order: The petition has been filed seeking extension of time granted in W.P.(MD)No.7628 of 2022, dated 25.04.2022 for a period of two weeks from 01.06.2022.
2.The learned counsel for the petitioner would submit that the petitioner while he was in Germany, he got affected by Covid-19 and his wife was also affected by Covid-19 and hence, he was not in a position to return India as directed by this Court. He has produced the medical certificates and also the return flight tickets. He would further submit that the petitioner has already booked ticket for return travel on 16.06.2022.
3.The learned Assistant Solicitor General of India appearing for the respondents has not raised any serious objections for allowing this petition 4.Considering the facts and circumstances and also the fact that the petitioner has already booked return ticket, this Court is inclined to extend the time.
5.Accordingly, this petition is ordered and time is extended till 17.06.2022 to comply with the order passed by this Court, dated 25.04.2022.
