Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 2nd respondent herein to issue the Legal Heir Certificate of deceased petitioners father namely Palanisamy based on his representation dated 26.08.2024. O R D E R

The petitioner has filed this Writ Petition seeking a mandamus, directing the second respondent to issue the 'Legal Heir Certificate' in respect of the petitioner's deceased father, namely, Palanisamy, based on his representation dated 26.08.2024.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. When the matter was taken up for hearing, the learned Special Government Pleader appearing on behalf of the respondents submitted that the petitioner has not submitted the required online application before the second respondent, who is the competent authority to consider the petitioner's request. Therefore, if the petitioner submits an online application to the second respondent, the same will be duly considered and appropriate orders will be passed in accordance with law. 2/5

In the light of the above submission, the petitioner is directed to file an online application before the second respondent within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of such application, the second respondent shall examine the same and pass appropriate orders on merits and in accordance with law, after giving due opportunity to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of four weeks thereafter. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to consider the same on its own merits.

5. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. 21.04.2025 Index : Yes / No Internet : Yes / No PKN 3/5
